SoloRider Liability Waiver

WAIVER OF LIABILITY AND RELEASE AGREEMENT FOR USE OF THE SOLORIDER GOLF CART

THIS IS A RELEASE OF LIABILITY. PLEASE READ CAREFULLY BEFORE SIGNING.

To the fullest extent provided by law, the undersigned hereby waives, releases, and discharges any and all right, claim or demand against Adaptive Golf Program, a Colorado Non-Profit Corporation, its Board of Directors, its Executive Director, its volunteers, agents, assigns, executors, administrators, trustees, insurers, employees, and any and all persons or entities with which it is associated (collectively “AGP”) for any injury, loss or damage to the undersigned, including any injury, illness, other claimed losses or damages and any other claims, and from any other loss, damage or expense that results from or in any way arises out of or relates to AGP’s provision of a SoloRider Golf Cart (SRGC) to the undersigned and for the provision of any related services, instructions or for any related activities.

The undersigned hereby releases and agrees not to sue AGP, referred to collectively as the “Release Parties” and hold the same harmless from and against any and all liability, claims, demands or actions or causes of action whatsoever, arising out of damage, loss or injury to the undersigned, whether anticipated or unanticipated, arising out of AGP’s provision of a SRGC and other services contemplated by this agreement, whether such claim, injury, damage, or loss results from the gross negligence of the Released Parties, their respective volunteers, agents, officers, employees, successors, assigns, insurers, etc., or from any other cause.

Undersigned hereby agrees to defend, indemnify and hold AGP harmless from any claim that may be made by any other person or individual that results from or in any way arises out of or relates to AGP’s provision of a SRGC and related services. Undersigned hereby also releases AGP from any and all claims for damages of whatsoever nature or kind that may occur to any personal property in use during the time in which AGP provides a SRGC to undersigned, whether arising out of AGP’s acts or some other incident which may include, but are not limited to fire, flood, storm, or any act of God, or damage in connection therewith, including monetary damages, costs and attorney’s fees of any kind.

Undersigned hereby agrees and understands that golf carts, including the SRGC are motorized vehicles and driving or riding in these vehicles can lead to serious injury, property damage and even death. As such undersigned further agrees to operate the SRGC in a safe manner and adhere to all course rules set forth by Hillcrest Golf Club. If the undersigned is observed abusing golf cart rules and regulations, including but not limited to reckless driving, speeding or allowing underage guests to operate the cart, will immediately forfeit all usage privileges.

Undersigned hereby agrees to provide their valid State driver’s license, or alternate identification showing they are at least 18 years of age. Exceptions to this requirement may be granted on a case by case basis, however final permission to use the SRGC equipment is at the sole discretion of the AGP Executive Director, Andrew Asmuth who may be contacted at: (303) 929-4410.

This release and agreement shall be binding upon the undersigned, his, her, or its insurers, heirs, successors, assigns, trusts, trustees, administrators, personal representatives, executors, directors, agents and employees. If any portion of this waiver of liability and release agreement is found to be void or unenforceable the remaining portions shall remain in full force and effect.

SOLORIDER GOLF CART POLICIES AND PROCEDURES

The Adaptive Golf Program, a Colorado Non-Profit Corporation (AGP), in association with Hillcrest Golf Club, is pleased to make available the SoloRider Golf Cart to the mobility-impaired community of golfers in Durango, Colorado. To help insure that you have a safe and enjoyable experience using the SoloRider Golf Cart please review the following policies and procedures which MUST be adhered to by all SoloRider Golfers.

  1. Contact Hillcrest Golf Club at: (970) 247-1499 to schedule your Tee Time, and to make sure the SoloRider is available, at least 48 hours in advance.
  2. Contact Adaptive Golf Program at: (303) 929-4410 with your Tee Time to schedule your SoloRider time slot.
  3. Please make certain you arrive at Hillcrest Golf Club at least ½ hour prior to your Tee Time to prepare and familiarize yourself with usage of the SoloRider.
  4. Hillcrest Golf Club has a strict Pace-Of-Play policy. All groups are expected to keep up with the group in front of them and play in 2 hours and 5 minutes or less, per 9 holes.
  5. SoloRider Golfers should wait for his or her turn before entering the green.
  6. Hillcrest Golf Club asks that you do NOT drive the SoloRider into sand bunkers. Please drop your ball within 2 club lengths of the sand trap and continue play. No penalty is enforced for this.
  7. Use of the SoloRider may be restricted due to turf and weather conditions, at the sole discretion of Hillcrest Golf Club management.
  8. All SoloRider Golf Cart golfers must comply with these Policies and Procedures, including the policies and rules of Hillcrest Golf Club.

SoloRider Usage and Best Practices

The SoloRider Golf Cart can be used to access the tees and greens with no impact to turf. It can also be driven over rough terrain with confidence and is designed to accommodate golfers with a variety of disabilities. Nevertheless, be very careful driving the vehicle on and off the greens.

Follow all posted entry and exit points to greens made by Hillcrest Golf Club management. In the absence of posted points of entry and exit, the SoloRider golfer must approach the ball from the shortest route possible. When exiting, take the shortest route by moving either forwards or backwards off the greens.

Avoid quick turns to help protect the turf and do NOT turn the cart around on the greens.
